A DUI in Utah isn’t .08%
For all the people who may be new to the Beehive State, keep in mind, the DUI level for BAC is different than your previous state.
I like this about Utah. I think most states are too soft on DUI's. And I think a big part of it is how prevalent drinking is in our culture. Meaning, the attorneys drink. The judges drink. The lawmakers drink. And all of them have probably been behind the wheel with some amount of alcohol in their system. Therefore, they may have unconsciously more sympathy or more leniency for people who drink and drive.
Not in Utah!
Utahns are bone dry. Like Elliott Ness. That's why we're a little more severe.
The legal Blood Alcohol Content in Utah isn't 0.08%, it's 0.05%.
Here's some details about it from provolawyers.com: (LINK TO FULL ARTICLE)
"Utah’s legal blood alcohol concentration (BAC) is somewhat different from most states as it is 0.05 percent instead of the standard 0.08. If a person has a BAC of 0.05 or greater while behind the wheel, they can be arrested and charged with DUI.
For drivers younger than 21 years old, there is no actual BAC limit. Instead, Utah has a law known as “not a drop,” meaning that people that young are prohibited from having any amount of alcohol in their systems while driving."
You also can get a DUI id you're not driving. If you are parked and just behind the wheel and you're over the legal limit you can be charged.
So just a heads up. If you're new things are a little different here in Utah.
