
Is Talking on Phone While Driving Illegal in Utah?
It's hard to keep track of what you can and can't do while driving from state to state.
We just did an article last week about how the DUI blood alcohol limit is different in Utah compared to most other states.
In Utah, it's 0.05 percent BAC, while most other states are 0.08 percent.
Well a question that gets asked a lot is: "I know it's illegal to text and drive but what about talking on my phone?"
According to highwaypatrol.utah.gov: (LINK TO FULL ARTICLE)
"You can talk on your phone while driving, but you are prohibited from manipulating your device while driving, meaning you cannot dial a phone number while driving. "
So it there's some nuance in the law.
Here's a portion of the statute for more context:
Subsection (2) does not prohibit an individual from using a wireless communication device while operating a moving motor vehicle: (LINK TO FULL LAW)
- when using a wireless communication device for voice communication;
- to view a global positioning or navigation device or a global positioning or navigation application;
- during a medical emergency;
- when reporting a safety hazard or requesting assistance relating to a safety hazard
- when reporting criminal activity or requesting assistance relating to a criminal activity
- when used by a law enforcement officer or emergency service personnel acting within the course and scope of the law
- enforcement officer's or emergency service personnel's employment; or to operate:
- hands-free or voice operated technology
- a system that is physically or electronically integrated into the motor vehicle
